18 - ACCREDITATION TO SIU VIA GUSI AND LEGAL REPRESENTATION

From the User manual: “The request in GUSI is usually submitted by the legal representative of a Body/Company or somebody else in charge”. Do we have to register ONCE as Organisation, with the President as Legal representative, and then insert our potential LPs as “users”, so that they can fill in the application Form?

Who is the person entitled to sign the proposal in SIU? Which documents attesting the power of signature or the delegation can be consider as valid legal documents?

What is it

GUSI

What is it for? The registration in the GUSI system is needed to obtain the username and password to enter the SIU system and fill in the Application Form.

Whose personal data shall be indicated in the request? Data of the Legal Representative or Person in charge of acting on behalf of the body have to be filled in in the first part of the GUSI request.

Who shall sign the request? The Legal Representative or Person in charge of acting on behalf of the body has to sign the GUSI request.

Who shall be indicated as user to be authorised to use the SIU? One or more users can be authorized by the organization. It is not necessary that the Legal Representative or Person in charge of signature is among the authorized users.

What if I need more than one user for the same organization? One of the authorised users can access GUSI (access for registered users function) and add other users. For complex organisations it is advisable that the organisation, identified by the TAX number, is registered only once with more than one user, if needed.

SIU

What is it for? The SIU allows applicants to fill in and submit the Application Form (AF).

Who shall operate in SIU? Only Lead Applicants shall access SIU.

The user who access the SIU can be a different person from the Legal Representative or the Person in charge of signature. The SIU user can be appointed by the organization with the sole role of entering data in the system.

Whose personal data shall be included? The system requires to fill in the data of the Legal Representative and, in case of delegation, of the Person in charge of signature.

Who shall sign the AF? The signature of the AF has to be made by the person whose data are included in the Legal Representative or Person in charge of signature sections of the AF.


Legal representative shall generally be the apical position in the organization (e.g. President, Mayor, etc). The legal representation is generally explicitly ruled in the organization’s founding documents (e.g. statute).

The person in charge of signature shall be delegated to sign either directly by the Legal Representative either by a person delegated by the Legal Representative if this option is explicitly foreseen in the organization’s founding documents (e.g. Delegation from the President to the Director of Department and delegation from the Director of Department to the Head of Unit).

As far as the declaration on the Power of Signature is concerned, applicants should produce and annex to the AF the POWER OF SIGNATURE DECLARATION which is mandatory. The Programme provides a template for this declaration which can be modified according to the needs of the organization. The declaration on the Power of Signature shall be used to explain where the power to sign the AF and/or the annexes derives from.

According to the different situations that can occur, the Power of Signature declaration shall be filled in as follows:

a. The Legal representative signs the AF and/or the annexes.

In the Power of Signature reference shall be made only to the Legal Representative with the indication of the organization’s funding document where the legal representation is ruled

b. The person in charge of signature signs the AF and/or the annexes and he/she is directly delegated by the Legal representative.

In the Power of Signature reference shall be made to:

the Legal Representative with the indication of the organization’s funding document where the legal representation is ruled
the person in charge of signature with the indication of the delegation act or other proof of power of signature (this act shall be attached)
c. The person in charge of signature signs the AF and/or the annexes but he/she is not directly c. delegated by the Legal representative.

In the Power of Signature reference shall be made to:

the Legal Representative with the indication of the organization’s founding document where the legal representation is ruled
the person delegated by the Legal Representative and who delegates the person in charge of signature with the indication of the delegation act or other proof of power of signature (this act shall be attached)
the person in charge of signature with the indication of the delegation act or other proof of power of signature (this act shall be attached)​​​​​​​
